Terms and Conditions for Tree Surgeons Camdentown Services

These Terms and Conditions set out the basis on which Tree Surgeons Camdentown provides tree surgery and related arboricultural services to domestic and commercial customers. By requesting a quotation, making a booking, or allowing our operatives to begin work, the customer agrees to these terms. These conditions are intended to be clear, fair, and consistent with UK consumer and business law. They apply to all agreed works, including pruning, crown work, felling, stump-related services where specified, site clearance, and associated arborist operations.

For the avoidance of doubt, these terms apply regardless of whether the customer is a homeowner, landlord, managing agent, business, or public-sector body. Any variation must be confirmed in writing by an authorised representative of Camdentown Tree Surgeons. If there is any inconsistency between a written quotation and these terms, the written quotation will take priority for the specific project details, provided that it does not conflict with mandatory legal requirements.

In these terms, references to we, us, and our mean the service provider trading as Tree Surgeons Camdentown. References to you and your mean the customer or person placing the order. Headings are included for convenience only and do not affect interpretation. Where a provision is found to be unlawful or unenforceable, the remaining provisions will continue to apply so far as legally permitted.

All work is subject to a quotation and an agreed booking. Quotations may be provided after an inspection, after a desk-based assessment, or based on information supplied by you. Any quotation is normally valid for a limited period stated on the quotation or, if no period is stated, for a reasonable time only. We may revise a quotation if the scope changes, if access conditions differ, if hidden defects are discovered, or if the information originally supplied was incomplete or inaccurate.

When you wish to proceed, you should confirm acceptance of the quote and requested date. A booking is not secured until we have accepted your instruction and, where requested, any deposit or pre-payment has been received. We may require photographs, tree locations, access details, parking arrangements, and information about overhead utilities, protected trees, or any constraints that could affect safe completion. You must provide accurate and complete information before the visit and keep us informed of any changes.

We reserve the right to decline or postpone a booking where we believe the work cannot be carried out safely, lawfully, or within the agreed scope. This may include situations where weather conditions, access restrictions, suspected structural instability, wildlife constraints, or third-party permissions prevent safe attendance. Any estimated times or dates are approximate unless we have expressly agreed otherwise in writing. Delays caused by traffic, weather, equipment failure, or factors outside our control do not amount to breach of contract.

Payment terms will be confirmed in the quotation or invoice. Unless otherwise agreed, payment is due immediately upon completion of the work, or in advance for booked service slots, specialist equipment hire, or larger projects. We may request a deposit to secure the date and cover preparatory costs. Tree surgery services that involve significant labour, disposal, traffic management, or access challenges may be invoiced in stages. Payment methods accepted will be communicated in advance and may include bank transfer, card payment, or other approved methods.

If payment is not made by the due date, we may charge reasonable interest and recovery costs in accordance with the Late Payment of Commercial Debts regime where applicable, or otherwise in line with statutory rights under UK law. Any admin fees, collection charges, or legal costs reasonably incurred in recovering overdue sums may be added where permitted. We may withhold further work, reports, or documentation until outstanding balances are settled in full.

Where a customer disputes an invoice, the undisputed balance must still be paid by the due date. You should raise any query promptly and provide supporting information. We will review the matter in good faith. However, a dispute does not justify withholding payment for work properly completed and accepted, except where the law allows. Title to any materials supplied does not pass until payment in full has been received.

Cancellation and rescheduling requests should be made as soon as possible. If you cancel after a booking has been confirmed, we may charge a cancellation fee to cover lost time, administration, and any non-recoverable costs. The amount will depend on how much notice you give and whether we have already incurred expenses such as permits, waste disposal arrangements, vehicle scheduling, or specialist crew allocation. Short-notice cancellations may be charged at the full or partial value of the booked service.

If you ask us to reschedule, we will try to agree a new date, but this is subject to availability. Where access is not possible on the agreed day due to locked gates, restricted parking, missing permissions, unsafe conditions caused by the customer, or the absence of someone authorised to grant access, the visit may be treated as a cancellation or failed attendance. In such circumstances, a call-out or wasted journey fee may apply.

If we must cancel or postpone the appointment, we will notify you as soon as reasonably possible and offer an alternative date where practical. We will not be liable for any indirect loss arising from a necessary cancellation where the reason is outside our control, such as severe weather, emergency repairs to equipment, illness, or legal restrictions. Your statutory rights are not affected, and any prepayments for work not carried out will be refunded or credited as appropriate.

We will perform the agreed work with reasonable care and skill, using suitable methods and competent personnel. However, tree surgery is inherently hazardous, and some risks cannot be eliminated entirely. You acknowledge that trees, branches, stems, roots, stumps, and surrounding ground conditions may conceal defects or unstable conditions. We are not responsible for pre-existing damage, concealed decay, fungal infection, root movement, or structural issues not reasonably visible at the time of inspection.

Liability is limited to losses directly caused by our proven negligence, breach of contract, or failure to use reasonable care and skill. We do not exclude liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded under UK law. Subject to those mandatory protections, we are not liable for indirect, consequential, or economic losses such as loss of profit, loss of use, or loss of business opportunity.

Where you have instructed us to work near walls, fences, paving, underground services, utilities, glass structures, sheds, vehicles, greenhouses, or neighbouring land, you accept that minor disturbance or incidental damage may occur despite reasonable care, especially where access is constrained or the ground is fragile. We are not liable for damage caused by hidden services, undocumented obstructions, or items that were not disclosed before work commenced. You should ensure all valuable or fragile items are removed from the work zone before our arrival.

Customers are responsible for securing any permissions, consents, or notices required for the work, including landowner consent, planning considerations, tree preservation matters, and access permissions where applicable. If a tree is subject to protection or any legal restriction, you must tell us in advance and provide any relevant approvals. If the work cannot lawfully proceed because the necessary approval has not been obtained, we may suspend, cancel, or revise the service and recover reasonable costs already incurred.

Where the work generates timber, branches, green waste, soil, or associated debris, the handling and removal of waste will be agreed in advance. Unless otherwise stated, we will remove only the waste specified in the quotation. Any retained timber, mulch, logs, or arisings become your responsibility once left on site or once you request that they be retained. We may recycle or dispose of waste in accordance with applicable environmental requirements and waste carrier obligations.

We operate in accordance with relevant UK waste regulations, including duties relating to controlled waste, transport, transfer, and lawful disposal. Waste will be taken only to authorised facilities or handled by approved routes. You must not ask us to dispose of prohibited materials, hazardous substances, or non-tree waste unless expressly agreed and lawfully permitted. If unexpected waste is discovered during the works, additional charges may apply for segregation, specialist handling, or disposal at appropriate facilities. Any customer-supplied waste descriptions must be accurate.

Health and safety is central to every service we provide. You agree to ensure that the site is reasonably safe and that hazards known to you are disclosed in advance. This includes concealed drains, unstable retaining structures, underground tanks, bee or wasp activity, contaminated land, or aggressive animals. We may stop work if conditions become unsafe. Our team may also refuse to proceed if personal protective equipment, access arrangements, or site conditions do not meet acceptable safety standards.

We will take reasonable steps to protect adjacent property, but tree work can involve the use of ropes, lowering systems, machinery, cutting tools, and vehicles. Some level of disturbance is unavoidable. You are responsible for ensuring that windows are closed, cars are moved, pets are secured, and vulnerable items are protected before work begins. If you fail to do this, we are not responsible for avoidable damage to those items unless caused by our negligence.

Any measurements, estimates, or recommendations we provide are based on the conditions visible at the time of inspection and on the information you supply. Trees can change between survey and attendance due to weather, disease, subsidence, or sudden breakage. If the actual condition differs from what was originally assessed, we may need to amend the method, schedule, or price. This does not amount to a breach if the change is necessary for safety or compliance.

Nothing in these terms limits your rights under the Consumer Rights Act 2015, the Consumer Contracts Regulations where applicable, or any other mandatory UK legislation. If you are a consumer, you have legal rights regarding services that are not performed with reasonable care and skill. If you are a business customer, our liability framework applies subject to any separate written agreement signed by both parties. Any warranties or guarantees must be expressly stated in writing to be enforceable.

We may suspend or terminate the agreement if you fail to pay, repeatedly change instructions, act abusively, or create unsafe conditions for our staff or subcontractors. We may also terminate if a material misrepresentation is discovered, if required permissions are absent, or if continuing would expose us to legal or safety risk. If the agreement ends early for reasons attributable to you, you must pay for work already completed and any unavoidable costs properly incurred.

These terms and the contract between us are governed by the laws of England and Wales. Any dispute arising from or in connection with the services, quotation, booking, or these terms will be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory law provides otherwise. If a court finds any provision invalid, the remainder will remain in force. These terms constitute the entire agreement unless varied in writing and accepted by both parties.
